Varying child support when income has changed
If your income or your former partner's income has changed materially since an existing child support order was made, you may be entitled to vary that order. Bavi assists with consent and contested motions to change child support within the FLSP-authorized scope.
Grounds for varying child support
- A significant change in the payor's annual income (line 15000 of the Notice of Assessment)
- A change in the child's living arrangements, shared custody percentages, or needs
- A change in a parent's ability to contribute due to job loss, disability, or new employment
- An agreement between both parties to update support to reflect current income figures
- The existing order was made based on income information that is now out of date
How we help
- Reviewing the existing order and both parties' current income information
- Calculating updated support using the Federal Child Support Guidelines and applicable tables
- Preparing consent motion documents or contested Form 15 materials
- Organizing financial disclosure including Notices of Assessment, T4s, and recent pay stubs
- Advising on filing, service requirements, and what to expect at the motion
How a motion to change proceeds
Order and income review
We review the existing support order and current income information for both parties to assess whether a material change in circumstances supports a variation under the Federal Child Support Guidelines.
Document preparation
We prepare the motion to change forms and assemble the required financial disclosure package — Notices of Assessment, T4s, and a financial statement — needed to support the updated support calculation.
Filing and court process
We assist with filing, service, and court scheduling. If both parties agree to the change, we pursue a consent order. If the matter is contested, we advise on next steps and hearing preparation.
